  1. MULTIPLE PRODUCT ORDERS

For a multiple product order, DHAUSE will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.

 

  1. ORDER ACCEPTANCE POLICY

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. DHAUSE reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item.

 

  1. OUT-OF-STOCK PRODUCTS

DHAUSE will ship your product as it becomes available. Usually, products ship the same day if ordered by 3:00PM, or by the next business day if your order is received after this time and for orders received on Saturday, Sunday or any major holiday. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.

 

  1. TAXES

Our Store shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the same state. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.

  1. CONDITION OF RETURN & EXCHANGE
  • Under Dhause Buyer Protection, all the claims for returning must be made within 14 days from the date of purchase, but a surface of 20% will be applied if the rationale of the return is because of not satisfied with the products and it is made from 8th days onwards from the date of purchase.
  • A return authorisation form must be filled in. To obtain the form please email csvkch@dhause.com.
  • Items that you return should not be used, washed, altered/tampered or soiled. All original packing, labels, tags, leaflets, manuals, warranty/guarantee cards, freebies, accessories such as belts, locks, straps, etc. should be intact. The courier will not accept your item in absence of these. Items with locks/passwords should be returned unlocked/disabled.
  • Electronic items: Upon receipt of your return request, we will arrange for a quality check to examine the complaint of the product being faulty/defective. Upon successful validation of the complaint we will process your request for return/replacement with regard to the faulty/defective electronic item(s). The returns/replacements will be for only those items which are found to be faulty/defective.
  • For certain types of defects reported, we may require a document from the brand/OEM’s service centre confirming that the delivered item was defective.
  • Some items are bound by the brand’s specific policies regarding repair, exchange and returns. These policies will be binding on the customer.
  • Replacements will depend on the availability of the item. In case the replacement item is out of stock, we will refund your amount.
  • Refund or replacement will be initiated once we receive your item and pass it through the necessary quality checks.
  • DHAUSE Gift Vouchers are not returnable or refundable for cash.

  1. CONDITION OF REFUNDS

Any refunds will be made in form of store credit which the Customer can use with the next purchase; refunds can not be made in cash or by credit/debit card or Paypal.

Refunds will be provided once the return authorisation form has been received with the products, and reasons of return is valid according to DHAUSE Buyer Protection.

 

  1. SHIPPING POLICY

Shipping Time — Most orders received before 3:00PM will ship the same day, provided the product ordered is in stock. Most orders received after 3:00 PM will ship the next business day. Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement. We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by DHAUSE or other parties only as an estimate. The time for delivery/performance shall not be of the essence, and DHAUSE shall not be liable for any delay in delivery or performance howsoever caused.

If DHAUSE has failed to deliver the Goods in accordance with the Contract or within a reasonable time, the Buyer shall be entitled, by serving written notice on DHAUSE, to demand performance within a specified time thereafter, which shall be at least 14 days. If DHAUSE fails to do so within the specified time, the Buyer shall be entitled to terminate the Contractin respect of the undelivered Goods and claim compensation for actual loss and expense sustained as a result of DHAUSE’s non-performance, which was foreseeable at the time of conclusion of the Contract and resulting from the usual course of events, subject always to the limitations set out in Condition of Liability (Forth Paragraph).

If the Buyer fails to take delivery of the Goods (otherwise than by reason of any cause beyond the Buyer’s reasonable control or by reason of DHAUSE’s fault) then without prejudice to any other right or remedy available to DHAUSE. DHAUSE may:

  • Sell the Goods at the best price readily obtainable and (after deducting all reasonable storage and selling expenses) account to the Buyer for the excess over the price under the Contract provided the price has been paid in cleared funds in full or charge the Buyer for any shortfall below the price under the Contract; or
  • Terminate the Contract and claim damages.

 

  1. RISK AND PROPERTY OF THE GOODS

Risk of damage to or loss of the Goods shall pass to the Buyer at the time of delivery or if the Buyer wrongfully fails to take delivery of the Goods, the time when DHAUSE has tendered delivery of the Goods.

Notwithstanding delivery and the passing of risk in the Goods or any other provision of these Conditions the property in the Goods shall not pass to the Buyer until DHAUSE has received in cash or cleared funds payment in full of the price of the Goods and all other goods agreed to be sold by DHAUSE to the Buyer for which payment is then due.

Until such time as the property in the Goods passes to the Buyer, the Buyer shall hold the Goods as DHAUSE’s fiduciary agent and bailee and shall keep the Goods separate from those of the Buyer.

The Buyer agrees with DHAUSE that the Buyer shall immediately notify DHAUSE of any matter from time to time affecting DHAUSE’s title to the Goods and the Buyer shall provide DHAUSE with any in-formation relating to the Goods as DHAUSE may require from time to time.

Until such time as the property in the Goods passes to the Buyer (and provided the Goods are still in existence and have not been resold) DHAUSE shall be entitled at any time to demand the Buyer to deliver up the Goods to DHAUSE and in the event of non-compliance DHAUSE reserves it’s right to take legal action against the Buyer for the delivery up the Goods and also reserves its right to seek damages and all other costs including but not limited to legal fees against the Buyer.

The Buyer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the Goods which remain the property of DHAUSE but if the Buyer does so all moneys owing by the Buyer to DHAUSE shall (without prejudice to any other right or remedy of DHAUSE) forthwith become due and payable.

If the provisions in this Condition of Risk and property of the Goods are not effective according to the law of the country in which the Goods are located, the legal concept closest in nature to retention of title in that country shall be deemed to apply mutatis mutandis to give effect to the underlying intent expressed in this condition, and the Buyer shall take all steps necessary to give effect to the same.

The Buyer shall indemnify DHAUSE against all loss damages costs expenses and legal fees incurred by the Buyer in connection with the assertion and enforcement of DHAUSE’s rights under this condition.

 

  1. WARRANTIES AND REMENDIES

Subject as expressly provided in these Conditions all other warranties conditions or terms, including those implied by statute or common law, are excluded to the fullest extent permitted by law.

Subject to this Condition of Warranties and Remendies, DHAUSE warrants that the Goods will correspond with their specification at the time of delivery, and agrees to remedy any non-conformity therein for a period of 12 months commencing from the date on which the Goods are delivered or deemed to be delivered (“Warranty Period”). Where the Buyer is dealing as a consumer (within the meaning of the Sale of Goods Act and the Consumer Protection Act), DHAUSE further gives to the Buyer such implied warranties as cannot be excluded by law. DHAUSE’s above warranty concerning the Goods is given subject to the following conditions:

  1. No condition is made or to be implied nor is any warranty given or to be implied as to the life or wear of the Goods supplied or that they will be suitable for any particular purpose or use under any specific conditions, notwithstanding that such purpose or conditions may be known or made known to DHAUSE.
  2. Any description given of the Goods is given by way of identification only and the use of such description shall not constitute a sale by description.
  3. DHAUSE binds itself only to deliver Goods in accordance with the general description under which they were sold, whether or not any special or particular description shall have been given or shall be implied by law. Any such special or particular description shall be taken only as the expression of DHAUSE’s opinion in that behalf. DHAUSE does not give any warranty as to the quality state condition or fitness of the Goods.
  4. DHAUSE shall be under no liability for the following measures and actions taken by the Buyer or third parties and the consequences thereof: improper remedy of defects, alteration of the Goods without the prior agreement of DHAUSE, addition and insertion of parts, in particular of spare parts which do not come from DHAUSE.
  5. DHAUSE shall be under no liability in respect of any defect arising from unsuitable or improper use, defective installation or commissioning by the Buyer or third parties, fair wear and tear, wilful damage, negligence, abnormal working conditions, defective or negligent handling, improper maintenance, excessive load, unsuitable operating materials and replacement materials, poor work, unsuitable foundation, chemical, electro-technical/electronic or electric influences, failure to follow DHAUSE’s instructions (whether oral or in writing) misuse or alteration or repair of the Goods without DHAUSE’s approval.
  6. DHAUSE is not liable for any loss damage or liability of any kind suffered by any third party directly or indirectly caused by repairs or remedial work carried out without DHAUSE’s prior written approval and the Buyer shall indemnify DHAUSE against each loss liability and cost arising out of such claims.
  7. DHAUSE shall be under no liability under the above warranty (or any other warranty condition or guarantee) if the total price for the Goods has not been paid in cleared funds by the due date for payment.
  8. DHAUSE shall be under no liability whatsoever in respect of any defect in the Goods arising after the expiry of the Warranty Period.

Any claim by the Buyer which is based on any defect in the quality or condition of the Goods or their failure to correspond with specification shall be notified to DHAUSE within seven days from the date of receipt of the Goods or (where the defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure. During use, the Goods shall be monitored constantly with regard to safety and defects. If there are even slight reservations concerning the suitability for use or the slightest reservations concerning safety, the Goods must not be used. DHAUSE shall be given written notification immediately, specifying the reservations or the defect. However in no event shall the Buyer be entitled to reject the Goods on the basis of any defect or failure, except where the failure is such that the Goods delivered are of a fundamentally different nature than those which DHAUSE had contracted to deliver.

If the Buyer does not give due notification to DHAUSE in accordance with the Condition as above, DHAUSE shall have no liability for any defect or failure or for any consequences resulting therefrom. Where any valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the Goods or their failure to meet a specification is notified to DHAUSE in accordance with Condition as above, the non-conforming Goods (or part thereof) will be repaired or replaced free of charge as originally ordered. Where the Goods have not been repaired or replaced within a reasonable time, despite a written warning from the Buyer, the Buyer shall be entitled to a reduction of the price in proportion to the reduced value of the Goods, provided that under no circumstance shall such reduction exceed 15% of the price of the affected Goods. In lieu of repair or replacement, DHAUSE may, at its sole discretion, grant such a reduction to the Buyer. Upon a repair, replacement or price reduction being made as aforesaid, the Buyer shall have no further claim against DHAUSE.

When DHAUSE has provided replacement Goods or given the Buyer a refund, the non-conforming Goods or parts thereof shall become DHAUSE’s property.

 

  1. OTHER CONDITIONS

These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether DHAUSE signs them or not. We reserve the right to make changes to this site and these Conditions at any time.

 

  1. TYPOGRAPHICAL ERRORS

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Our Store shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Our Store shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Our Store shall immediately issue a credit to your credit card account in the amount of the incorrect price.
